1. Acceptance of Terms

By accessing or using this website, submitting a service request, requesting an estimate, scheduling an appointment, or engaging our services, you agree to these Terms and Conditions and the applicable Privacy Policy. If you do not agree with these terms, you should discontinue use of the website and services.

Any work performed at your property may also be governed by a separate written service agreement, proposal, estimate, work order, or other project documentation.

2. Website Usage

This website provides general information about home services, project planning, estimates, consultations, and related offerings. Website content is provided for informational purposes and may not reflect the specific conditions, requirements, pricing, or availability of an individual property or project.

You agree to use the website lawfully and responsibly and not to interfere with its operation, security, availability, or functionality.

3. Service Usage

Information displayed on the website does not replace an on-site property assessment, inspection, professional evaluation, or project consultation. Service availability, scope, materials, pricing, deliverables, and completion requirements are confirmed through applicable written documentation before work begins.

Where a signed project agreement contains terms that differ from general website information, the applicable project agreement will generally control the specific service or project.

4. User Responsibilities

You agree to provide accurate, complete, and current information when submitting enquiries, requesting estimates, scheduling services, or communicating about a project. You should disclose known property hazards, access restrictions, structural concerns, utility issues, or other conditions that may reasonably affect the work.

You are also responsible for securing pets, valuables, fragile belongings, and personal property before work begins.

5. Property Access and Preparation

You must provide reasonable and safe access to areas where services are scheduled. Work may be delayed, suspended, or rescheduled if required access is unavailable or if property conditions create an unreasonable safety risk.

Customers should prepare the work area as reasonably requested and remove or protect items that could interfere with the service.

6. Pricing and Payments

Written estimates and proposals remain valid only for the period stated in the applicable document. Pricing may depend on project scope, labor, materials, site conditions, availability, and other factors identified during the planning process.

Payment schedules and applicable payment requirements are established in the service agreement. Overdue balances may result in delays, suspension, or other remedies where permitted by the applicable agreement and law.

7. Changes to the Scope of Work

Requests to add, remove, modify, or otherwise change the original scope of work may affect project pricing, materials, scheduling, and completion requirements.

Additional work generally requires customer approval through a written change order or other written authorization before the additional work begins, except where immediate action is reasonably necessary to address an urgent safety or property concern.

8. Materials and Products

Materials and products will be selected according to the applicable project agreement, approved specifications, availability, suitability, and project requirements. If a specified product becomes unavailable, an alternative may be proposed where reasonably necessary.

Customer-provided materials may be subject to limitations if they are defective, incompatible, incomplete, improperly specified, or otherwise unsuitable for the intended application.

9. Scheduling

Start dates and project schedules depend on signed approvals, site readiness, required permits, inspections, material availability, staffing, and other project conditions.

Weather, supply interruptions, inspection requirements, unexpected property conditions, transportation issues, or other circumstances may affect the anticipated schedule. We will make reasonable efforts to communicate material changes as soon as practical.

10. Unforeseen Property Conditions

Repair, renovation, maintenance, and improvement projects may reveal conditions that were not reasonably visible or known before work began. These may include concealed structural damage, moisture problems, electrical issues, plumbing conditions, defective materials, pest-related damage, or other hidden conditions.

When unforeseen conditions materially affect the project, additional work, costs, materials, or schedule changes may be required and may be addressed through an appropriate change order or revised project agreement.

11. Permits and Approvals

Some projects may require permits, inspections, approvals, homeowner association permissions, utility coordination, or compliance with applicable building and safety requirements.

Responsibility for obtaining required permits or approvals will depend on the nature of the project and the responsibilities established in the applicable service agreement.

12. Safety Requirements

We may refuse, delay, or suspend work when conditions present an unreasonable risk to workers, customers, occupants, visitors, property, or equipment. Customers must disclose known hazards and should not request work that violates applicable laws, regulations, safety requirements, or professional standards.

13. Warranty

Applicable workmanship warranties are governed by the terms stated in the written service or project agreement. Warranty coverage may be subject to specific durations, exclusions, procedures, and limitations.

Normal wear, misuse, neglect, accidents, unauthorized alterations, improper maintenance, damage caused by third parties, and conditions outside the original scope of work may not be covered.

14. Manufacturer Warranties

Products and equipment installed as part of a project may be covered by separate manufacturer warranties. Such warranties are subject to the manufacturer's terms, conditions, exclusions, registration requirements, maintenance requirements, and claim procedures.

15. Third-Party Services

Some projects may involve independent contractors, specialist trades, suppliers, inspectors, manufacturers, delivery providers, or other third parties. Their work, products, schedules, and warranties may be governed by separate terms.

We may coordinate with these parties where reasonably necessary to complete or support a requested project.

16. Customer Property

Customers are responsible for protecting valuables, fragile belongings, electronics, artwork, furniture, and other personal property that may be affected by construction, repair, maintenance, or installation activities.

Reasonable care will be taken during service, but customers should take appropriate precautions for items that may be vulnerable to dust, vibration, movement, tools, materials, or other ordinary project conditions.

17. Cancellation and Rescheduling

Cancellation or rescheduling requests should be made as early as reasonably possible. Depending on the applicable agreement, charges may apply for completed work, specially ordered materials, scheduled labor, third-party commitments, or other non-recoverable project expenses.

18. Completion and Inspection

Upon substantial or final completion of applicable work, customers should review the completed service and promptly identify any concerns or apparent deficiencies.

Where applicable, reported issues will be reviewed according to the project agreement, warranty terms, and the nature of the concern.

19. Website Content

Descriptions, photographs, illustrations, service examples, pricing information, project images, and other website content are provided for general informational purposes. Actual results, materials, availability, pricing, project duration, and service requirements may vary based on individual circumstances.

We do not guarantee that all website content will always be complete, current, error-free, or continuously available.

20. Intellectual Property

Website content, including text, graphics, photographs, illustrations, layouts, designs, documents, logos, icons, and other materials, may be protected by intellectual property laws.

You may not reproduce, modify, distribute, publish, sell, or commercially exploit protected website materials without appropriate authorization.

21. Prohibited Activities

You may not use the website to submit false or misleading information, impersonate another person, attempt unauthorized access, interfere with website functionality, introduce malicious software, misuse forms or service-request tools, scrape protected content, or engage in activity that violates applicable laws or the rights of others.

22. Privacy

Personal information collected through the website, service requests, consultations, project communications, or other online interactions is handled according to the applicable Privacy Policy.

By using the website or requesting services, you acknowledge that information may be collected, used, stored, and shared as described in the Privacy Policy and as otherwise permitted by applicable law.

23. Limitation of Liability

To the fullest extent permitted by applicable law, liability arising from a particular service or project is limited to direct losses connected to the affected service and will not exceed the amount paid for that specific service.

To the extent permitted by law, we are not responsible for indirect, incidental, special, exemplary, or consequential losses arising from the use of the website or services.

24. Events Beyond Reasonable Control

We are not responsible for delays or failures caused by circumstances beyond reasonable control, including severe weather, natural disasters, utility interruptions, material shortages, supplier delays, transportation disruptions, labor shortages, government actions, emergencies, or other extraordinary circumstances.

25. Termination Rights

Either party may terminate a service agreement for material breach after providing written notice and, where appropriate, a reasonable opportunity to resolve the issue.

Termination does not eliminate responsibility for completed work, approved changes, committed materials, outstanding payments, or other authorized costs incurred before termination.

26. Suspension of Services

Services may be suspended when required payments are overdue, safe access is unavailable, required approvals are missing, unsafe conditions exist, requested work cannot lawfully be performed, or continued work would create an unreasonable risk.

27. Dispute Resolution

If a dispute arises concerning services, pricing, scheduling, project conditions, warranties, payments, or these terms, the parties should first make reasonable efforts to resolve the matter through communication and review of the applicable project documentation.

Nothing in this section prevents either party from pursuing remedies that cannot lawfully be waived or restricted.

28. Governing Law

These Terms and Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Disputes will be handled by courts having appropriate jurisdiction in Travis County, Texas, unless another lawful resolution method is required by an applicable written agreement or by law.

29. Severability

If any provision of these terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the extent necessary, while the remaining provisions will continue in full force and effect to the extent permitted by law.

30. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in services, website functionality, business practices, technology, or applicable legal requirements.

Updated terms will be made available through the website and will apply as permitted by applicable law. Specific project agreements may continue to govern services already agreed to by the parties.

31. Entire Agreement

These Terms and Conditions, together with the applicable Privacy Policy, service agreement, estimate, proposal, work order, change orders, and other written project documents, may collectively establish the terms governing a particular service.

Where a specific written project agreement conflicts with these general website terms, the applicable project agreement will generally control the specific matter addressed in that agreement.

32. Acknowledgment

By accessing the website, submitting a request, requesting an estimate, scheduling a service, approving project work, or otherwise engaging with our services, you acknowledge that you have had an opportunity to review these Terms and Conditions and agree to comply with the applicable provisions.
